Information clause in the recruitment process.

–    Your personal data within the scope specified in Article 22(1) §§ 1 and 2 of the Labour Code shall be processed in order to implement the employment process, i.e. to exercise special rights in the field of labour law, social security and social protection, meeting the requirements of law concerning the employment relationship, settlement of remuneration within the scope of the current law on personal income tax, notification and settlement of social and health insurance contributions, preventive health care. Legal basis: Article 22(1) §§ 1 and 2 of the Labour Code in connection with Article 6(1)(b) and Article 9(2)(b) of the Regulation of 27 April 2016. (GDPR)/; in order to fulfil the legal obligation imposed on the controller. Legal basis: Article 22(1) § 2 of the Labour Code in connection with Article 6(1)(c) of the Regulation of 27 April 2016. (GDPR),

–    Providing your personal data referred to in Article 22(1)(1) and (2) above is voluntary but necessary for implementation of the employment process,

–    Please be advised that transferring other data than those specified in Article 22(1) §§ 1 and 2 of the Labour Code may take place if the obligation to provide them results from separate provisions of law or if the applicant for employment or an employee granted his/ her consent – is voluntary and will not be the basis for unfavorable treatment – and will be taken into account only if it is beneficial for the candidate for employment or an employee, and cannot constitute a reason justifying refusal to employ, termination of employment contract or its termination without notice by the employer,

–    Your data referred to above, collected in order to carry out the employment process, will be processed throughout the entire period of employment and for a subsequent period – in accordance with the applicable provisions of law – of the next 50 years from the termination of employment,

–    Expected categories of data recipients: Human Resources and Organizations Department employees, management deciding about employment, Occupational Medicine Clinic, Company Management Board, Social Insurance Institution (ZUS), Tax Office and other institutions and offices of state administration which document the processing data pursuant to relevant provisions of law.

–    Please be advised that your personal data will not be passed on to any third countries,

–  You have right to access your personal data to rectify, erase or restrict the processing, right to transfer your data and right to object the processing,

–    You also have right to lodge a complaint with the President of the Office for Personal Data Protection if it is justified to think that the Controller processes your data contrary to the GDPR.

–    Your data will be processed manually and automatically during the contract drawing and employment process, but this will not result in automated decision making.

–    Your Personal Data will be processed according to the Article 22(1) § 1 of the Labour Code in order to:

a) fulfil the legal obligation imposed on the controller. Legal basis: Article 22(1) § 1 of the Labour Code in connection with Article 6(1)(c) of the Regulation of 27 April 2016 (GDPR),

b) if you give your additional voluntary consent, your personal data will also be processed:

I. in terms of your image – the legal basis is: Article 22(2) § 1 of the Labour Code in connection with Article 6(1)(a) of the Regulation of 27 April 2016. (GDPR),

II. in terms of the future recruitment – the legal basis is: Article 22(2) § 1 of the Labour Code in connection with Article 6(1)(a) of the Regulation of 27 April 2016. (GDPR),

–    If you give any of the above consents, you will have the right to withdraw any of them at any time without affecting the lawfulness of the processing carried out on the basis of consent given prior to the withdrawal. Consent can be revoked as follows, by writing an email to the address: rekrutacja@eeodlewnia.pl.

–    Providing the personal data referred to in point (a) above is voluntary, but necessary to take part in the recruitment process. Providing the data and expressing the consent referred to in point (b) above is voluntary and does not affect the possibility of participation in the recruitment process (it will not be the basis for unfavorable consideration of the candidate and will not constitute any reason justifying the refusal to employ),

–    Voluntary data referred to in points (a) and (b) (I.) and collected in order to carry out the recruitment process will be processed for a period of 6 months from the publication of the advertisement, and data processed on the basis of consent for future recruitments – point (II) above – for a period of 1 year,

–    Expected categories of data recipients: Human Resources and Organizations Department employees, management deciding about employment, Occupational Medicine Clinic, recruitment services providers,

–    Please be advised that your personal data will not be passed on to any third countries,

–    You have right to access your personal data to rectify, erase or restrict the processing, right to transfer your data and right to object the processing,

–    You have right to withdraw your consent at any time by contacting us at the address specified above, and withdrawal of the consent shall not affect legality of the processing carried out on its basis before the consent has been withdrawn,

–    You also have right to lodge a complaint with the President of the Office for Personal Data Protection if it is justified to think that the Controller processes your data contrary to the GDPR.

–    Your data will be processed automatically during the contract drawing to verify its accuracy, but this will not result in automated decision making and profiling within the meaning of Article 22 of the GDPR regulation.

Information Clause For Customers And EE Associates

 

In accordance with the Article 13 (1–2) of Regulation (EU) 2016/679 of the European Parliament and the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (EU Official Journal L119, p. 1), hereinafter referred to as the GDPR, we hereby inform you that:

1.    Your Personal Data Controller is Odlewnia Zawiercie Spółka Akcyjna with its registered office in Zawiercie, ul. Leśna 10, Phone No: +48 32 671 82 00, e-mail: iodo@eeodlewnia.pl The Management Board acts on behalf of the Company in persons: Mr. Maciej Litwiński and Mr. Sebastian Kliciński.

2.    No Personal Data Protection Officer has been appointed at the Company.

3.    Your personal data will be processed for several purposes, i.e. to properly perform a contract, to fulfill our legal obligations, including tax related obligations. They may also be used for the purpose of asserting potential claims under the civil law and defending against such claims, if any.

4.    The legal basis for the processing of personal data is:

– Art. 6 (1b) of the GDPR, i.e. processing is necessary for the performance of a contract to which the data subject is a party.

– Art. 6 (1c) of the GDPR, i.e. processing is necessary for compliance with a legal obligation, including financial and tax obligation, to which the Company is subject.

– Art. 6 (1f) of the GDPR, i.e. processing is necessary for the purposes of the legitimate interests pursued by the Company, including the possible need to defer or enforce civil law claims.

5.    Your personal data will be stored for the period necessary for a specific data processing, i.e. for no longer than duration of the contract and for the period of possible claims related to the contract, i.e. for at least 10 years from the contract conclusion, performance or termination, respectively, in accordance with the general limitation period pursuant to Art. 118 of the Civil Code of 23 April 1964.

6.    Your personal data will be disclosed solely to persons authorized by the personal data controller (such as authorized employees) or entities authorized under the law regulations and to entities to which the Company will outsource services related to the processing of the personal data, e.g. IT services, transport or legal services. Such entities process the data on the basis of a contract with the Company and only in accordance with its instructions.

7.    The data controller does not intend to transfer your personal data to any third countries or any international organizations.

8.    You have right to access your personal data and right to request that it be rectified, erased or limited in use and that it be transferred.

9.    If you consider that the provisions of the GDPR have been breached, you have right to lodge a complaint with the supervisory authority, i.e. The President of National Data Protection Authority.

10.    Although providing us your personal data is voluntary, it is necessary for conclusion and implementation of an agreement between you and the Company.

11.    Your personal data will not be used for automated decision making or profiling as referred to in Art. 22 of the GDPR.

This clause has been updated on 25th May 2018 and may be subject to further changes. If required by law, any information relating to the future changes or additions to the processing of personal data described in this clause that may involve you will be communicated to you through the appropriate means of communication, generally used by the Company in its dealings with customers and associates.

5.    Your personal data will be stored for the period necessary for a specific data processing, i.e. for no longer than duration of the contract and for the period of possible claims related to the contract, i.e. for at least 10 years from the contract conclusion, performance or termination, respectively, in accordance with the general limitation period pursuant to Art. 118 of the Civil Code of 23 April 1964.
